Section 4Substantive

Overriding effect of Act

Full Text

Save as otherwise expressly provided in this Act,—

(a) any text, rule or interpretation of Hindu law or any custom or usage as part of that law in force immediately before the commencement of this Act shall cease to have effect with respect to any matter for which provision is made in this Act;

(b) any other law in force immediately before the commencement of this Act shall cease to have effect in so far as it is inconsistent with any of the provisions contained in this Act.

Plain English Summary

Establishes the overriding supremacy of the Act over all prior Shastric Hindu texts, customs, usages, or inconsistent pre-existing statutory laws on matters covered herein.

Key Legal Elements

  • Prior Hindu shastric texts, rules, and customary laws cease to have effect on matters provided in this Act
  • Any pre-existing inconsistent statutory laws are rendered void and ineffective to the extent of inconsistency
  • Customs survive only where expressly saved by provisions within this Act

Practical Note

Where the Hindu Marriage Act covers an issue, prior Shastric rules or conflicting laws are completely superseded unless the Act itself preserves a custom (e.g., Section 5(iv) and (v)).
