Conditions for a Hindu marriage

A marriage may be solemnized between any two Hindus, if the following conditions are fulfilled, namely:—

(i) neither party has a spouse living at the time of the marriage;

(ii) at the time of the marriage, neither party—

(a) is incapable of giving a valid consent to it in consequence of unsoundness of mind; or

(b) though capable of giving a valid consent, has been suffering from mental disorder of such a kind or to such an extent as to be unfit for marriage and the procreation of children; or

(c) has been subject to recurrent attacks of insanity;

(iii) the bridegroom has completed the age of twenty-one years and the bride, the age of eighteen years at the time of the marriage;

(iv) the parties are not within the degrees of prohibited relationship unless the custom or usage governing each of them permits of a marriage between the two;

(v) the parties are not sapindas of each other, unless the custom or usage governing each of them permits of a marriage between the two.

हिंदी पाठ

किन्हीं भी दो हिन्दुओं के बीच विवाह अनुष्ठापित किया जा सकेगा, यदि निम्नलिखित शर्तें पूरी हो जाएं, अर्थात्:—

(i) विवाह के समय दोनों पक्षों में से किसी का भी कोई जीवित पति या पत्नी न हो;

(ii) विवाह के समय दोनों पक्षों में से कोई भी—

(क) चित्तविकृति के परिणामस्वरूप विधिमान्य सम्मति देने में असमर्थ न हो; या

(ख) विधिमान्य सम्मति देने में समर्थ होने पर भी इस प्रकार के या इस हद तक मानसिक विकार से पीड़ित न रहा हो कि वह विवाह तथा सन्तानोत्पत्ति के लिए अयोग्य हो; या

(ग) उसे उन्मत्तता के बार-बार दौरे न पड़ते रहे हों;

(iii) विवाह के समय वर ने इक्कीस वर्ष की आयु और वधू ने अठारह वर्ष की आयु पूरी कर ली हो;

(iv) पक्षकार प्रतिषिद्ध नातेदारी की डिग्रियों के भीतर न हों, जब तक कि उनमें से प्रत्येक को शासित करने वाली रूढ़ि या प्रथा दोनों के बीच विवाह की अनुज्ञा न देती हो;

(v) पक्षकार एक-दूसरे के सपिण्ड न हों, जब तक कि उनमें से प्रत्येक को शासित करने वाली रूढ़ि या प्रथा दोनों के बीच विवाह की अनुज्ञा न देती हो।
