Application of rules

Full Text

The following rules shall not apply to any Chartered High Court in the exercise of its ordinary or extraordinary original civil jurisdiction, namely:—

(1) rule 10 and rule 11, clauses (b) and (c), of Order VII;

(2) rule 3 of Order X;

(3) rule 2 of Order XVI;

(4) rules 5, 6, 8, 9, 10, 11, 13, 14, 15 and 16 (so far as relates to the manner of taking evidence) of Order XVIII;

(5) rule 1 to 8 of Order XX; and

(6) rule 7 of Order XXXIII (so far as relates to the making of a memorandum);

and rule 35 of Order XLI shall not apply to any such High Court in the exercise of its appellate jurisdiction.

Non-Applicability of Order VII Rule 10 & 11(b),(c): In the Chartered High Courts, a plaint cannot be rejected under Order VII Rule 11(b) or (c) for undervaluation or insufficient stamping in the manner applicable to subordinate courts. The High Court's own Master / Taxing Officer determines court fee and valuation under Original Side Rules. 2. Flexibility in Recording Evidence: Rules of Order XVIII regarding long-hand recording of depositions by the judge or translating in court do not bind Chartered High Courts. The Judge may direct evidence to be recorded by a Court Stenographer, Commissioner, or electronic audio-video recording. 3. Appellate Decrees: Under Order 41 Rule 35 exclusion, appellate decrees of Division Benches are drawn up according to the Letters Patent and Original Side Rules rather than the standardized district court decree format.

निम्नलिखित नियम किसी चार्टर्ड उच्च न्यायालय को उसकी मामूली या असाधारण आरंभिक सिविल अधिकारिता (Ordinary or Extraordinary Original Civil Jurisdiction) के प्रयोग में लागू नहीं होंगे, अर्थात्:—

(1) आदेश 7 का नियम 10 तथा नियम 11 के खंड (ख) और (ग);

(2) आदेश 10 का नियम 3;

(3) आदेश 16 का नियम 2;

(4) आदेश 18 के नियम 5, 6, 8, 9, 10, 11, 13, 14, 15 और 16 (जहां तक वे साक्ष्य लेने की रीति से संबंधित हैं);

(5) आदेश 20 के नियम 1 से 8; तथा

(6) आदेश 33 का नियम 7 (जहां तक वह ज्ञापन बनाने से संबंधित है);

और आदेश 41 का नियम 35 ऐसे किसी उच्च न्यायालय को उसकी अपीलीय अधिकारिता के प्रयोग में लागू नहीं होगा।
