Saving in respect of Chartered High Courts
Full Text
Nothing in this Schedule shall be deemed to limit or otherwise affect any rules in force at the commencement of this Code for the taking of evidence or the recording of judgments and orders by a Chartered High Court.
Plain English Summary
Protects and saves pre-existing Original Side Rules and Letters Patent powers of Chartered High Courts regarding the recording of evidence and pronouncement of judgments from being curtailed by the First Schedule of the CPC.
Key Legal Elements
- Preservation of Original Side Autonomy: Rules in force at CPC commencement governing evidence and judgments remain intact.
- Supremacy of Letters Patent: Reinforced by Section 4 and Section 129 CPC.
- Flexible Record Taking: High Courts may record evidence through shorthand transcribers or commissioners in accordance with their internal rules.
Practical Note
Interaction Between CPC and High Court Original Side Rules: 1. Section 129 and Letters Patent Powers: Order XLIX Rule 2 expressly preserves the Letters Patent and Original Side Rules of the Chartered High Courts. In Iridium India Telecom Ltd. v. Motorola Inc. (2005) 2 SCC 145, the Supreme Court affirmed that rules framed by Chartered High Courts under Section 129 CPC regulate their original civil jurisdiction and take precedence over inconsistent provisions in the CPC schedule.
