Provincial Small Cause Courts

The provisions hereinafter specified shall not extend to Courts constituted under the Provincial Small Cause Courts Act, 1887 (9 of 1887) or under the Berar Small Cause Courts Law, 1905 or to Courts exercising the jurisdiction of a Court of Small Causes under the said Act or Law or to Courts in any part of India to which the said Act does not extend exercising a corresponding jurisdiction that is to say—
(a) so much of this Schedule as relates to—
(i) suits excepted from the cognizance of a Court of Small Causes or the execution of decrees in such suits;
(ii) the execution of decrees against immovable property or the interest of a partner in partnership property;
(iii) the settlement of issues; and
(b) the following rules and orders:—
Order II, rule 1 (frame of suit);
Order X, rule 3 (record of examination of parties);
Order XV, except so much of rule 4 as provides for the pronouncement at once of judgment;
Order XVIII, rules 5 to 12 (evidence);
Order XLI to XLV (appeals);
Order XLVII, rules 2, 3, 5, 6, 7 (review);
Order LI.

Practical Note
Practice and Procedure Before Provincial Small Cause Courts (JSCC): 1. Execution Against Immovable Property: Under clause (a)(ii) read with Section 7 CPC, a Court of Small Causes has no jurisdiction to execute a decree against immovable property. If the judgment-debtor possesses no movable property, the decree-holder must obtain a transmission certificate under Section 39 CPC to execute the decree through the Court of the Civil Judge (Senior Division) against the debtor's land or building (K.V. Swaminathan v. K.V. Lakshmanan, AIR 1963 Mad 217). 2. Summary Judgments without Issues: In Rameshwar Dayal v. Banda (1993) 1 SCC 530, the Supreme Court confirmed that a Small Cause Court is not required to frame formal issues or write an elaborate judgment discussing every piece of evidence. Under Order XX Rule 4(1), it is sufficient if the judgment states the points for determination and the decision thereon. 3. Remedy is Revision under Section 25, Not Appeal: Because Orders XLI to XLV are expressly excluded by clause (b), no appeal lies against a Small Cause Court decree. The sole remedy is a Civil Revision under Section 25 of the Provincial Small Cause Courts Act, 1887 before the High Court/District Court on questions of law.

इसमें इसके पश्चात विनिर्दिष्ट उपबंध प्रांतीय लघुवाद न्यायालय अधिनियम, 1887 (1887 का 9) के अधीन अथवा बेरार लघुवाद न्यायालय विधि, 1905 के अधीन गठित न्यायालयों को, अथवा उक्त अधिनियम या विधि के अधीन लघुवाद न्यायालय की अधिकारिता का प्रयोग करने वाले न्यायालयों को अथवा भारत के किसी ऐसे भाग में जिसमें उक्त अधिनियम का विस्तार नहीं है तदनुरूपी अधिकारिता का प्रयोग करने वाले न्यायालयों को लागू नहीं होंगे, अर्थात्:—
(क) इस अनुसूची का उतना भाग जो निम्नलिखित से संबंधित है—
(i) ऐसे वाद जो लघुवाद न्यायालय के संज्ञान से अपवर्जित हैं अथवा ऐसे वादों में डिक्रियों का निष्पादन;
(ii) स्थावर (अचल) संपत्ति के विरुद्ध अथवा भागीदारी संपत्ति में किसी भागीदार के हित के विरुद्ध डिक्रियों का निष्पादन;
(iii) विवाद्यकों का स्थिरीकरण (Settlement of Issues); तथा
(ख) निम्नलिखित नियम और आदेश:—
आदेश 2, नियम 1 (वाद की विरचना);
आदेश 10, नियम 3 (पक्षकारों की परीक्षा का अभिलेख);
आदेश 15, नियम 4 के उस भाग को छोड़कर जो तुरंत निर्णय सुनाए जाने का उपबंध करता है;
आदेश 18, नियम 5 से 12 (साक्ष्य);
आदेश 41 से 45 (अपीलें);
आदेश 47, नियम 2, 3, 5, 6, 7 (पुनर्विलोकन);
आदेश 51।
