Process to be served at expense of party issuing

Full Text

(1) Every process issued under this Code shall be served at the expense of the party on whose behalf it is issued, unless the Court otherwise directs.

(2) Costs of service.—The court-fee chargeable for such service shall be paid within a time to be fixed before the process is issued.

Plain English Summary

Directs that all processes issued under the Code (summons, notices, warrants) shall be served at the expense of the party initiating them, requiring payment of process fees (talbana) within the time fixed by the court prior to issuance.

Key Legal Elements

  • Expense on Initiating Party: Primary responsibility for cost of process rests on the applicant/plaintiff.
  • Advance Deposit of Process Fee: Process fee (talbana) and postal charges must be paid within fixed time before issuance.
  • Consequence of Default: Failure to deposit process fee leads to dismissal for default under Order IX Rule 2 CPC.
  • Court Exemption Power: Discretion to direct service at State expense in legal aid or indigent person cases.

Practical Note

Compliance with Process Fee (Talbana / PF) Timelines: 1. Strict Timelines for Depositing PF & RC: In Indian civil practice, trial courts routinely order 'PF (Process Fee) and RC (Registered Cover) to be filed within 7 days'. Counsel must ensure strict compliance with this deadline because under Order IX Rule 2 CPC, failure to pay process fees within the time fixed results in summary dismissal of the suit or proceeding against that defendant. 2. Legal Aid Exemption: Where a party is represented by Legal Aid or permitted to sue as an indigent person under Order XXXIII, the court invokes 'unless the Court otherwise directs' under sub-rule (1) to issue process free of cost at the expense of the State.
