Orders and notices how served

Full Text

All orders, notices and other documents required by this Code to be given to or served on any person shall be served in the manner provided for the service of summons.

Plain English Summary

Serves as the universal procedural bridge across the Code, establishing that all orders, show-cause notices, and procedural documents shall be served in the same manner provided for the service of summons under Order V.

Key Legal Elements

  • Universal Procedural Bridge: Extends the entire jurisprudence of Order V (Rules 9 to 30) to every notice under the Code.
  • Applicability across Orders: Governs injunction notices (O.39 R.3), execution notices (O.21 R.22), appeal notices (O.41 R.14), review notices (O.47 R.4).
  • Substituted Service Available: Inability to serve personal notice allows invoking substituted service under Order V Rule 20.
  • Due Process Safeguard: Non-compliance with Order V requirements renders service defective, vitiating ex-parte proceedings.

Practical Note

The Pivotal Role of Rule 2 in Service Jurisprudence: 1. Universal Application of Order V: Order XLVIII Rule 2 is the statutory bridge linking every notice provision in the CPC to Order V. Whenever notice is mandated (e.g. execution show-cause under Order XXI Rule 22, appeal notice under Order XLI Rule 14, or review under Order XLVII Rule 4), service MUST strictly conform to the modes sanctioned by Order V (personal service, speed post, approved courier, email, or newspaper publication under Rule 20). 2. Strict Natural Justice Test: In Sushil Kumar Sabharwal v. Gurpreet Singh (2002) 5 SCC 377, the Supreme Court held that service of summons or notice is an indispensable condition of natural justice. Any deviation from the summons procedure imported via Rule 2 entitles the aggrieved party to set aside ex-parte orders under Order IX Rule 13.
