Section O47R9Procedural

Bar of certain application

Full Text

No application to review an order made on an application for a review or a decree or order passed or made on a review shall be entertained.

Plain English Summary

Establishes an absolute statutory bar against entertaining a second review application: no review lies against an order rejecting or granting a review, or against a fresh decree passed upon review.

Key Legal Elements

  • Absolute Bar on Second Review: Prohibits 'review of a review'.
  • Applies to All Outcomes: Bar covers orders rejecting review, orders granting review, and revised decrees passed post-review.
  • Public Policy Principle: Interest reipublicae ut sit finis litium (it is in the public interest that there be an end to litigation).

Practical Note

Finality and the Prohibition Against Second Reviews: 1. Principle of Finality: Rule 9 is an absolute statutory embodiment of finality in litigation. If a party's review application is rejected, they cannot file a second review petition before the same court. The only remedy is to challenge the decree and rejection in the superior appellate forum or under Article 136 of the Constitution. 2. Inherent Powers Cannot Bypass Rule 9: The Supreme Court has repeatedly affirmed that Section 151 CPC cannot be invoked to entertain a second review application in teeth of the express statutory prohibition in Rule 9.
