Registry of application granted, and order for re-hearings
Full Text
When an application for review is granted, a note thereof shall be made in the register and the Court may at once re-hear the case or make such order in regard to the re-hearing as it thinks fit.
Plain English Summary
Directs that when a review application is granted, it shall be registered and the court may proceed immediately to re-hear the case or schedule a future date for substantive re-hearing.
Key Legal Elements
- Registration Entry: Formal entry in the civil court register noting the grant of review.
- Stage 3 Re-Hearing: Transition from reviewing the grounds to re-hearing the substantive controversy.
- Scope of Re-Hearing: Confined strictly to the points on which review was granted.
Practical Note
Limiting Re-Hearing to Reviewed Points: 1. Scope of Re-Hearing under Rule 8: Granting review under Rule 4 does not reopen the entire case from scratch for unrestricted re-trial. The re-hearing contemplated by Rule 8 is strictly confined to the specific error apparent or new evidence on which the review was allowed (Haridas Das v. Usha Rani Banik, 2006 4 SCC 78).
