Order of rejection not appealable. Objections to order granting application

Full Text

(1) An order of the Court rejecting the application shall not be appealable; but an order granting an application may be objected to at once by an appeal from the order granting the application or in an appeal from the decree or order finally passed or made in the suit.

(2) Where the application has been rejected in consequence of the failure of the applicant to appear, he may apply for an order to have the rejected application restored to the file, and, where it is proved to the satisfaction of the Court that he was prevented by any sufficient cause from appearing which such application was called on for hearing, the Court shall order it to be restored to the file upon such terms as to costs or otherwise as it thinks fit, and shall appoint a day for hearing the same.

(3) No order shall be made under sub-rule (2) unless notice of the application has been served on the opposite party.

(1) आवेदन को नामंजूर करने वाला न्यायालय का आदेश अपीलनीय नहीं होगा; किंतु आवेदन को मंजूर करने वाले आदेश पर उस आवेदन को मंजूर करने वाले आदेश की तुरंत अपील करके अथवा वाद में अंततः पारित या की गई डिक्री या आदेश से अपील में आक्षेप किया जा सकेगा।

(2) जहां आवेदक के उपसंजात होने में विफलता के परिणामस्वरूप आवेदन नामंजूर कर दिया गया है, वहां वह नामंजूर किए गए आवेदन को फाइल पर प्रत्यावर्तित (पुनर्स्थापित) कराने के आदेश के लिए आवेदन कर सकेगा, और जहां न्यायालय के समाधानप्रद रूप से यह साबित कर दिया जाता है कि जब ऐसा आवेदन सुनवाई के लिए पुकारा गया था तब वह उपसंजात होने से किसी पर्याप्त हेतुक से निवारित रहा था, तो न्यायालय ऐसे खर्चों या अन्यथा निबंधनों पर जैसा वह ठीक समझे, उसे फाइल पर पुनर्स्थापित करने का आदेश करेगा, और उसकी सुनवाई के लिए एक दिन नियत करेगा।

(3) उप-नियम (2) के अधीन कोई भी आदेश तब तक नहीं किया जाएगा जब तक कि आवेदन की सूचना की विरोधी पक्षकार पर तामील न हो चुकी हो।
