Application where rejected

Full Text

(1) Where the application for a review is heard by more than one Judge and the Court is equally divided, the application shall be rejected.

(2) Where there is a majority, the decision shall be according to the opinion of the majority.

Plain English Summary

Provides that where a multi-judge bench hearing a review petition is equally divided, the application must be rejected, and where there is a majority, the majority opinion prevails.

Key Legal Elements

  • Equal Division = Rejection: In a two-judge bench, if one judge is for granting and one for rejecting, the application stands rejected.
  • Presumption of Validity: Original decree stands undisturbed unless a majority resolves to review it.
  • Majority Rule: In larger benches, majority opinion decides.

Practical Note

Equal Division Mechanics in Review vs Appeals: 1. Contrast with Section 98 CPC: In regular appeals, when a division bench is equally divided on a point of law, Section 98(2) directs reference to a third judge. In contrast, under Order XLVII Rule 6(1), if the judges are equally divided, the review petition is REJECTED outright without any third-judge reference, preserving the finality of the original judgment.
