List of witnesses and summons to witnesses
Full Text
(1) On or before such date as the Court may appoint, and not later than fifteen days after the date on which the issues are settled, the parties shall present in Court a list of witnesses whom they propose to call either to give evidence or to produce documents and obtain summonses to such persons for their attendance in Court.
(2) A party desirous of obtaining any summons for the attendance of any person shall file in Court an application stating therein the purpose for which the witness is proposed to be summoned.
(3) The Court may, for reasons to be recorded, permit a party to call, whether by summoning through Court or otherwise, any witness, other than those whose names appear in the list referred to in sub-rule (1), if such party shows sufficient cause for the omission to mention the name of such witness in the said list.
(4) Subject to the provisions of sub-rule (2), summonses referred to in this rule may be obtained by the parties on an application to the Court or to such officer as may be appointed by the Court in this behalf within five days of presenting the list of witnesses under sub-rule (1).
Plain English Summary
Mandates parties to submit a witness list within 15 days of framing issues specifying the purpose of each witness. Unlisted witnesses may only be summoned with court leave upon demonstrating sufficient cause.
Key Legal Elements
- 15-Day Statutory Window: List of witnesses must be filed within 15 days from framing of issues under Order XIV.
- Statement of Purpose (Sub-rule 2): Application for summons must articulate the specific relevance and purpose of summoning.
- Sufficient Cause Exception (Sub-rule 3): Judicial discretion to permit calling omitted witnesses upon showing reasonable and bona fide cause.
- 5-Day Window for Summons Application (Sub-rule 4): Application for issuing process must be made within 5 days of filing list.
Practical Note
Strategic Practice under Order XVI Rule 1: 1. Landmark Precedent - Mange Ram v. Brij Mohan (1983) 4 SCC 36: The Supreme Court held that the 15-day timeline is directory and not mandatory. Sub-rule (3) confers broad discretion to allow omitted witnesses if genuine cause is shown, preventing substantive justice from being defeated by technical default. 2. Vidhyadhar v. Manikrao (1999) 3 SCC 573: Failure of a party to enter the witness box to substantiate factual pleadings draws an adverse inference under Section 114(g) of the Evidence Act. 3. Courtroom Drafting: Heading of application: 'Application under Order XVI Rule 1(3) read with Section 151 CPC for permission to summon and examine witness omitted from the witness list with affidavit of sufficient cause'.
