Consequences of non-compliance with orders

Where any party fails to comply with the order of the Court passed in a Case Management Hearing, the Court shall have the power to—
(a) condone such non-compliance by payment of costs to the Court;
(b) foreclose the non-compliant party’s right to file affidavits, conduct cross-examination of witnesses, file written submissions, address oral arguments or make further arguments in the trial, as the case may be, or
(c) dismiss the plaint or allow the suit where such non-compliance is wilful, repeated and the imposition of costs is not adequate to ensure compliance.

जहां कोई पक्षकार केस मैनेजमेंट हियरिंग में पारित न्यायालय के आदेश का अनुपालन करने में असफल रहता है, वहां न्यायालय को निम्नलिखित शक्तियां होंगी:—
(क) न्यायालय को खर्चे का संदाय कराकर ऐसे अननुपालन को माफ करना;
(ख) यथास्थिति, अननुपालन करने वाले पक्षकार का साक्ष्य का शपथपत्र दाखिल करने, साक्षियों से प्रतिपरीक्षा (Cross-examination) करने, लिखित बहस दाखिल करने, मौखिक बहस करने अथवा विचारण में आगे कोई दलील प्रस्तुत करने का अधिकार हमेशा के लिए समाप्त (Foreclose) कर देना; अथवा
(ग) जहां ऐसा अननुपालन जानबूझकर (Wilful), बार-बार (Repeated) किया गया हो तथा अनुपालन सुनिश्चित करने के लिए खर्चे अधिरोपित करना पर्याप्त न हो, वहां वादपत्र को खारिज करना अथवा वाद को सीधे डिक्री (Allow the suit) कर देना।
