Parties at issue

Full Text

(1) Where the parties are at issue on some question of law or of fact, and issues have been framed by the Court as hereinbefore provided, if the Court is satisfied that no further argument or evidence that the parties can at once adduce is required upon such of the issues as may be sufficient for the decision of the suit, and that no injustice will result from proceeding with the suit forthwith, the Court may proceed to determine such issues, and, if the finding thereon is sufficient for the decision, may pronounce judgment accordingly, whether the summons has been issued for the settlement of issues only or for the final disposal of the suit: Provided that, where the summons has been issued for the settlement of issues only, the parties or their pleaders are present and none of them objects.

(2) Where the finding is not sufficient for the decision, the Court shall postpone the further hearing of the suit, and shall fix a day for the production of such further evidence, or for such further argument as the case requires.

Plain English Summary

Permits the court to forthwith determine issues and pronounce judgment at the first hearing if satisfied that no further oral evidence or argument is required for decision, provided that where summons was for issues only, appearing parties raise no objection.

Key Legal Elements

  • Immediate Determination of Framed Issues: Enables disposal of suits on pure documentary record without trial.
  • No Injustice Standard: Court must ensure no party is deprived of a legitimate evidentiary defense.
  • Consent Proviso: If summons was for settlement of issues only, parties/pleaders must be present and neither must object.
  • Adjournment for Inconclusive Findings (Sub-rule 2): Court fixes date for evidence if preliminary findings are insufficient.

Practical Note

Disposing of Suits on Admitted Documents: Where a suit turns purely on the interpretation of a registered deed, decree, or statute, and issues are framed under Order XIV, counsel can state under Rule 3: 'Both parties are present. No oral evidence is needed. We pray that this Hon'ble Court determine the issues forthwith and pronounce judgment under Order XV Rule 3 CPC'.
