One of several defendants not at issue

Full Text

(1) Where there are more defendants than one, and any one of the defendants is not at issue with the plaintiff on any question of law or of fact, the Court may at once pronounce judgment for or against such defendant and the suit shall proceed only against the other defendants.

(2) Whenever a judgment is pronounced under this rule, decree shall be drawn up in accordance with such judgment and the decree shall bear the date on which the judgment was pronounced.

Plain English Summary

Authorizes immediate judgment and drawing of a decree for or against any single non-contesting co-defendant at the first hearing, while the suit proceeds independently against the remaining contesting defendants.

Key Legal Elements

  • Severable Co-Defendant Adjudication: Immediate resolution of liability for non-contesting defendants.
  • Suit Proceeds Against Remainder: Continues toward trial exclusively against contesting co-defendants.
  • Independent Executable Decree (Sub-rule 2): Draws up formal decree bearing judgment date.

Practical Note

Strategic Use in Multi-Defendant Suits: In a recovery suit against Borrower (Defendant 1) and Guarantor (Defendant 2), if the Borrower admits liability while the Guarantor disputes execution, plaintiff can obtain an immediate decree against Defendant 1 under Order XV Rule 2 while proceeding to trial against Defendant 2.
