Failure to produce evidence

Full Text

Where the summons has been issued for the final disposal of the suit and either party fails without sufficient cause to produce the evidence on which he relies, the Court may at once pronounce judgment, or may, if it thinks fit, after framing and recording issues, adjourn the suit for the production of such evidence as may be necessary for its decision upon such issues.

Plain English Summary

Authorizes the court to at once pronounce judgment if a party fails without sufficient cause to produce evidence on a summons issued for final disposal, or in its discretion adjourn the suit after framing issues.

Key Legal Elements

  • Summons for Final Disposal: Triggered under Order V Rule 5 where summons explicitly commanded final disposal (common in Small Cause Courts).
  • Default Sanction: Immediate pronouncement of judgment against the defaulting party.
  • Alternative Discretion: Court can alternatively frame issues and grant an adjournment for evidence.

Practical Note

Small Cause and Summary Suits: In Small Cause Courts or summary trials where summons is for final disposal, parties must bring their witnesses and evidence on the first returnable date. Failure to do so risks immediate adverse judgment under Order XV Rule 4.
