Section 494Procedural

Bond required from child

Full Text

When the person required by any Court, or officer to execute a bond is a child, such Court or officer may accept, in lieu thereof, a bond executed by a surety or sureties only.

Plain English Summary

Provides a simplified procedure for minors, allowing the Court to accept a bond executed solely by sureties instead of requiring a personal bond from the child.

Key Legal Elements

  • Special provision for minors
  • Waiver of personal bond from child
  • Surety-only bond acceptance
  • Transfer of legal liability to adult sureties

Practical Note

Legally, a minor cannot enter into a binding contract. Therefore, the law allows the bond to be executed solely by adult sureties/guardians who can be held legally accountable.
