Rape.

A man is said to commit rape who, except in the case which is not rape, has sexual intercourse with a woman under circumstances falling under any of the following seven descriptions:—\n(a) Against her will.\n(b) Without her consent.\n(c) With her consent, when her consent has been obtained by putting her or any person in whom she is interested, in fear of death or of hurt.\n(d) With her consent, when the man knows that he is not her husband and that her consent is given because she believes that he is another man to whom she is or believes herself to be lawfully married.\n(e) With her consent, when, at the time of giving such consent, by reason of unsoundness of mind or intoxication or the administration by him personally or through another of any stupefying or unwholesome substance, she is unable to understand the nature and consequences of that to which she gives consent.\n(f) With or without her consent, when she is under eighteen years of age.\n(g) When she is unable to communicate consent.\nExplanation 1.— For the purposes of this section, "sexual intercourse" shall mean any of the following acts, namely:—\n(i) penetration, even to the slightest degree, of the vagina, mouth, urethra or anus of a woman by the man with his penis;\n(ii) inserting, to any extent, any object or a part of the body, not being the penis, into the vagina, the urethra or anus of a woman or into the mouth of a woman;\n(iii) manipulating any part of the body of a woman so as to cause penetration into the vagina, urethra, anus or any part of the body of such woman;\n(iv) applying his mouth to the vagina, anus, urethra of a woman or making her to do so with him or any other person.\nExplanation 2.— Penetration is sufficient to constitute the sexual intercourse necessary to the offence of rape.\nExplanation 3.— Sexual intercourse by a man with his own wife, the wife not being under eighteen years of age, is not rape.

बलात्संग।\nकोई पुरुष बलात्संग करता है, यह तब कहा जाता है, जब वह उस मामले के सिवाय जो बलात्संग नहीं है, किसी स्त्री के साथ निम्नलिखित सात वर्णनों में से किसी के भी अधीन आने वाली परिस्थितियों में मैथुन करता है, अर्थात् :—\n(क) उसकी इच्छा के विरुद्ध ;\n(ख) उसकी सम्मति के बिना ;\n(ग) उसकी सम्मति से, जब कि उसकी सम्मति उसे या किसी ऐसे व्यक्ति को जिसमें वह हितबद्ध है, मृत्यु की या उपहति की उपहति के भय में डालकर प्राप्त की गई है ;\n(घ) उसकी सम्मति से, जब कि वह पुरुष यह जानता है कि वह उसका पति नहीं है और उसकी सम्मति इसलिए दी गई है क्योंकि वह विश्वास करती है कि वह ऐसा अन्य पुरुष है जिससे वह विधिपूर्वक विवाहित है या अपने को विधिपूर्वक विवाहित मानती है ;\n(ङ) उसकी सम्मति से, जब कि ऐसी सम्मति देते समय वह विकृतचित्तता या मत्तता के कारण या उसके द्वारा स्वयं या किसी अन्य के माध्यम से किसी जड़कारी या अस्वास्थ्यकर पदार्थ दिए जाने के कारण उस बात की प्रकृति और परिणामों को समझने में असमर्थ है जिसके लिए वह सम्मति देती है ;\n(च) उसकी सम्मति से या उसके बिना, जब कि वह अठारह वर्ष से कम आयु की है ;\n(छ) जब वह सम्मति संसूचित करने में असमर्थ है ।\nस्पष्टीकरण 1— इस धारा के प्रयोजनों के लिए, “मैथुन” से निम्नलिखित कार्यों में से कोई भी अभिप्रेत होगा, अर्थात् :—\n(i) पुरुष द्वारा अपने लिंग को किसी स्त्री की योनि, मुख, मूत्रमार्ग या गुदा में किसी भी विस्तार तक प्रविष्ट करना ;\n(ii) पुरुष द्वारा लिंग के न होते हुए भी किसी वस्तु को या शरीर के किसी भाग को किसी स्त्री की योनि, मूत्रमार्ग या गुदा में या किसी स्त्री के मुख में किसी भी विस्तार तक प्रविष्ट करना ;\n(iii) किसी स्त्री के शरीर के किसी भाग के साथ इस प्रकार हेरफेर करना जिससे ऐसी स्त्री की योनि, मूत्रमार्ग, गुदा या शरीर के किसी भाग में प्रविष्टि कारित हो जाए ;\n(iv) अपना मुख किसी स्त्री की योनि, गुदा, मूत्रमार्ग से लगाना या उससे स्वयं के साथ या किसी अन्य व्यक्ति के साथ ऐसा करने को कहना ।\nस्पष्टीकरण 2— पैठ बलात्संग के अपराध के लिए आवश्यक मैथुन गठित करने के लिए पर्याप्त है ।\nस्पष्टीकरण 3— पुरुष द्वारा अपनी ही पत्नी के साथ मैथुन, यदि पत्नी अठारह वर्ष से कम आयु की नहीं है, बलात्संग नहीं है ।
