Application of Code of Criminal Procedure, 1973 to proceedings before a Special Court

Save as otherwise provided in this Act, the provisions of the Code of Criminal Procedure, 1973 (2 of 1974) (including the provisions as to bail and bonds) shall apply to the proceedings before a Special Court and for the purposes of the said provisions, the Special Court shall be deemed to be a court of Sessions and the person conducting a prosecution before a Special Court, shall be deemed to be a Public Prosecutor.

The procedures for trial of warrant cases by Magistrates under Section 33(1) modify standard Sessions procedure.

इस अधिनियम में अन्यथा उपबंधित के सिवाय, दंड प्रक्रिया संहिता, 1973 (1974 का 2) के उपबंध (जिसके अंतर्गत जमानत और बंधपत्रों से संबंधित उपबंध भी हैं) विशेष न्यायालय के समक्ष कार्यवाही पर लागू होंगे और उक्त उपबंधों के प्रयोजनों के लिए, विशेष न्यायालय को सेशन न्यायालय समझा जाएगा और विशेष न्यायालय के समक्ष अभियोजन का संचालन करने वाले व्यक्ति को लोक अभियोजक समझा जाएगा।
