Presentment of cheque to charge any other person
Full Text
Presentment of cheque to charge any other person.—A cheque must, in order to charge any person except the drawer, be presented within a reasonable time after delivery thereof by such person.
Plain English Summary
Directs that in order to hold any person other than the drawer (such as endorsers) liable on a cheque, it must be presented within a reasonable time after delivery by that person.
Key Legal Elements
- Applies when seeking to hold someone other than the drawer liable
- The cheque must be presented to the bank within a reasonable time
- The reasonable time is calculated from the date of delivery by that specific person
Practical Note
Protects intermediate endorsers of cheques. If a cheque is endorsed by B to C, and C delays presenting it for months, B is discharged from liability if the delay causes prejudice. Unlike the drawer whose liability is longer, endorsers are only bound if presentment is made in a reasonable time from their transfer.
