Practical Note

1. SECTION 143A IS DISCRETIONARY, NOT MANDATORY (Landmark 2024 SC Ruling): • In Rakesh Ranjan Shrivastava v. State of Jharkhand, (2024) 4 SCC 719, the Supreme Court held that the word "may" in Section 143A confers judicial discretion. The court CANNOT mechanically award 20% interim compensation in every case. A speaking order recording reasons evaluating prima facie merits, financial capacity of the accused, and plausibility of defense is mandatory. 2. PROSPECTIVE APPLICATION ONLY: • In G.J. Raja v. Tejraj Sharma, (2019) 19 SCC 469, the Supreme Court held that Section 143A is substantive in nature and applies PROSPECTIVELY only to complaints instituted after September 1, 2018. 3. ADVOCATE PRACTICE TIPS: • For Complainant: Move the application under Section 143A immediately upon recording the plea under Section 251 CrPC. Emphasize undisputed invoices/ledgers to justify the maximum 20% award. • For Accused: Oppose by demonstrating a strong plausible defense (time-barred debt, no statutory notice service, security misuse). • Enforcement: Default in payment within 60+30 days does not cancel bail; it is recovered via attachment of movable/immovable assets as a fine under Section 421 CrPC / Section 461 BNSS.
