Power of Court to try cases summarily.—(1) Notwithstanding anything contained in the Code of Criminal Procedure, 1973 (2 of 1974) all offences under this Chapter shall be tried by a Judicial Magistrate of the first class or by a Metropolitan Magistrate and the provisions of sections 262 to 265 (both inclusive) of the said Code shall, as far as may be, apply to such trials:
Provided that in the case of any conviction in a summary trial under this section, it shall be lawful for the Magistrate to pass a sentence of imprisonment for a term not exceeding one year and an amount of fine exceeding five thousand rupees:
Provided further that when at the commencement of, or in the course of, a summary trial under this section, it appears to the Magistrate that the nature of the case is such that a sentence of imprisonment for a term exceeding one year may have to be passed or that it is, for any other reason, undesirable to try the case summarily, the Magistrate shall after hearing the parties, record an order to that effect and thereafter recall any witness who may have been examined and proceed to hear or rehear the case in the manner provided by the said Code.
(2) The trial of a case under this section shall, so far as practicable, consistently with the interests of justice, be continued from day to day until its conclusion, unless the Court finds the adjournment of the trial beyond the following day to be necessary for reasons to be recorded in writing.
(3) Every trial under this section shall be conducted as expeditiously as possible and an endeavour shall be made to conclude the trial within six months from the date of filing of the complaint.

1. SUMMARY TRIAL IS THE STATUTORY RULE: • Under Section 143(1), summary trial is the statutory mandate. In Re: Expeditious Trial of Cases under Sec 138 (2021 SC Suo Motu), the Supreme Court instructed trial courts not to mechanically convert summary trials into summons trials without recording cogent reasons. • De Novo Trial on Transfer: If a Magistrate hearing a summary trial is transferred, the successor Magistrate CANNOT rely on evidence recorded by the predecessor and must hold a de novo trial unless converted into a regular summons case with witnesses recalled (J.V. Baharuni v. State of Gujarat, (2014) 10 SCC 494). 2. EXPEDITION & 6-MONTH TARGET: • Section 143(2) mandates day-to-day trial; every adjournment beyond the next day requires written recording of reasons. • Section 143(3) sets an explicit target of 6 months for conclusion of trial from complaint filing. • Evidence of complainant and witnesses is taken on affidavit under Section 145 to accelerate trial.

मामलों का संक्षेपतः विचारण करने की न्यायालय की शक्ति।—(1) दंड प्रक्रिया संहिता, 1973 (1974 का 2) में किसी बात के होते हुए भी, इस अध्याय के अधीन सभी अपराधों का विचारण प्रथम वर्ग न्यायिक मजिस्ट्रेट या महानगर मजिस्ट्रेट द्वारा किया जाएगा और उक्त संहिता की धारा 262 से 265 (दोनों सहित) के उपबंध, जहां तक हो सके, ऐसे विचारणों पर लागू होंगे:
परंतु इस धारा के अधीन संक्षिप्त विचारण में किसी दोषसिद्धि की दशा में, मजिस्ट्रेट के लिए एक वर्ष से अनधिक की अवधि के कारावास और पांच हजार रुपये से अधिक के जुर्माने का दंडादेश पारित करना विधिपूर्ण होगा:
परंतु यह और कि जब इस धारा के अधीन किसी संक्षिप्त विचारण के प्रारंभ में, या उसके दौरान, मजिस्ट्रेट को यह प्रतीत होता है कि मामले की प्रकृति ऐसी है कि एक वर्ष से अधिक की अवधि के कारावास का दंडादेश पारित करना पड़ सकता है या किसी अन्य कारण से मामले का संक्षेपतः विचारण करना अवांछनीय है, तो मजिस्ट्रेट पक्षकारों को सुनने के पश्चात उस प्रभाव का एक आदेश अभिलिखित करेगा और तत्पश्चात किसी भी ऐसे साक्षी को पुनः बुला सकेगा जिसकी परीक्षा की जा चुकी हो और उक्त संहिता द्वारा उपबंधित रीति से मामले की सुनवाई या पुनः सुनवाई करने के लिए अग्रसर होगा।
(2) इस धारा के अधीन किसी मामले का विचारण, न्याय के हित के अनुरूप जहां तक साध्य हो, उसकी समाप्ति तक दिन-प्रतिदिन जारी रखा जाएगा, जब तक कि न्यायालय अगले दिन से आगे विचारण के स्थगन को लेखबद्ध किए जाने वाले कारणों से आवश्यक न पाए।
(3) इस धारा के अधीन प्रत्येक विचारण यथासंभव शीघ्रता से संचालित किया जाएगा और परिवाद दाखिल करने की तारीख से छह मास के भीतर विचारण को समाप्त करने का प्रयास किया जाएगा।
