Cheque crossed specially
Full Text
Cheque crossed specially.—Where a cheque bears across its face an addition of the name of a banker, either with or without the words “not negotiable,” that addition shall be deemed a crossing and the cheque shall be deemed to be crossed specially, and to be crossed to that banker.
Plain English Summary
Defines special crossing as the addition of a specific banker's name across the cheque's face, directing payment solely to or through that designated bank.
Key Legal Elements
- Addition of the name of a specific banker across the face of the cheque
- Parallel transverse lines are customary but not legally mandatory for special crossing
- May be with or without words not negotiable
- Restricts payment exclusively to the named banker or its collecting agent
Practical Note
Provides enhanced security over general crossing. An instrument crossed specially to a particular bank can only be collected by that bank. Any other bank attempting to collect it will have the cheque returned, preventing fraud in transit.
