(3) There shall be no appeal under this section on the subject of costs only.
(4) Every appeal under this section shall be preferred within a period of ninety days from the date of the decree or order.
Plain English Summary
Governs statutory appeals against all substantive matrimonial decrees and final orders under Sections 25 and 26, barring appeals purely on costs and setting a 90-day limitation period.
Key Legal Elements
- All substantive decrees are appealable as regular civil decrees
- Orders under Section 25 (permanent maintenance) and Section 26 (child custody) are appealable only if final, not interim
- No appeal lies solely on the question of costs
- Limitation period of 90 days from the date of decree or order for filing appeal
Practical Note
Limitation for filing an appeal is 90 days (amended from 30 days in 2003). Crucially, interim maintenance orders under Section 24 are not appealable under Section 28(2) as they are interim; challenge lies via Article 227 supervisory petition before the High Court.
