Disposal of property

In any proceeding under this Act, the court may make such provisions in the decree as it deems just and proper with respect to any property presented, at or about the time of marriage, which may belong jointly to both the husband and the wife.

Practical Note
Section 27 applies strictly to property presented around marriage belonging jointly to both spouses. For exclusive Stridhan belonging solely to the wife, Section 406 IPC / Section 316 BNS or an ordinary civil suit remains the primary legal remedy.

इस अधिनियम के अधीन किसी भी कार्यवाही में, न्यायालय विवाह के समय या उसके आसपास भेंट की गई ऐसी किसी भी संपत्ति के संबंध में, जो पति और पत्नी दोनों की संयुक्त हो, डिक्री में ऐसे उपबंध कर सकेगा जैसे वह न्यायसंगत और उचित समझे।
