(2) Nothing in sub-section (1) shall prevent the court from laying down its own procedure for disposal of an application under section 12 or under sub-section (2) of section 23.
Plain English Summary
Save as otherwise provided, all proceedings and offenses under this Act are governed by the Code of Criminal Procedure, 1973, while allowing courts to devise their own procedures for applications.
Key Legal Elements
- CrPC, 1973 governs proceedings for key reliefs (Sections 12, 18-23) and offenses under Section 31.
- Court is empowered to formulate its own summary procedures to dispose of Section 12 or Section 23(2) applications.
- Balances structured criminal laws with flexible procedural relief.
Practical Note
Provides a hybrid procedure. Although criminal procedure (CrPC) is generally followed, sub-section (2) gives judges absolute flexibility to design civil-like summary procedures to expedite maintenance or ex parte orders.
