Where rejection of plaint does not preclude presentation of fresh plaint
Full Text
The rejection of the plaint on any of the grounds hereinbefore mentioned shall not of its own force preclude the plaintiff from presenting a fresh plaint in respect of the same cause of action.
Plain English Summary
Clarifies that the rejection of a plaint under Rule 11 does not operate as res judicata, preserving the plaintiff's right to present a fresh plaint upon curing formal defects, subject to limitation.
Key Legal Elements
- No Res Judicata Bar: Rejection under Rule 11 is not an adjudication on substantive merits.
- Right to File Fresh Plaint: Valid where plaint was rejected for deficit court fee, lack of duplicate, or curable cause of action defects.
- Limitation Caveat: Fresh plaint must be within the prescribed period of limitation (or benefit of Sec. 14 Limitation Act if applicable).
Practical Note
Strategic Choice - Appeal vs. Fresh Suit: 1. Choice of Remedies: When a plaint is rejected for non-payment of court fee (Rule 11c) or clerical defect, the plaintiff has two options: (i) File an Appeal under Section 96, OR (ii) File a fresh suit with correct court fees under Rule 13, provided the claim is still within limitation.
