Section O7R12Procedural
Procedure on rejecting plaint
Full Text
Where a plaint is rejected the Judge shall record an order to that effect with the reasons for such order.
Plain English Summary
Mandates that every judicial order rejecting a plaint must explicitly record detailed reasons, serving as the formal basis for appellate decree adjudication.
Key Legal Elements
- Speaking Order Mandate: Reasoned order is indispensable; cryptic rejection is unsustainable.
- Formal Basis for Decree: The reasoned order forms the decree under Section 2(2) for regular appeal.
- Judicial Accountability: Ensures appellate scrutiny of the grounds of rejection.
Practical Note
Appellate Requirement: The order rejecting the plaint must be a speaking order. An appellate court will remand the matter if the trial judge rejected the plaint without addressing each statutory requirement of Rule 11.
