Particulars to be contained in plaint

The plaint shall contain the following particulars:—

(a) the name of the Court in which the suit is brought;

(b) the name, description and place of residence of the plaintiff;

(c) the name, description and place of residence of the defendant, so far as they can be ascertained;

(d) where the plaintiff or the defendant is a minor or a person of unsound mind, a statement to that effect;

(e) the facts constituting the cause of action and when it arose;

(f) the facts showing that the Court has jurisdiction;

(g) the relief which the plaintiff claims;

(h) where the plaintiff has allowed a set-off or relinquished a portion of his claim, the amount so allowed, or relinquished; and

(i) a statement of the value of the subject-matter of the suit for the purposes of jurisdiction and of court-fees, so far as the case admits.

[Y], upon which ad valorem court fee of Rs. [Z] is paid'.

वादपत्र में निम्नलिखित विशिष्टियां होंगी:—

(क) उस न्यायालय का नाम जिसमें वाद लाया गया है;

(ख) वादी का नाम, वर्णन और निवास-स्थान;

(ग) प्रतिवादी का नाम, वर्णन और निवास-स्थान, जहां तक वे अभिनिश्चित किए जा सकें;

(घ) जहां वादी या प्रतिवादी अवयस्क अथवा विकृतचित्त व्यक्ति है, वहां उस भाव का कथन;

(ङ) वे तथ्य जिनसे वाद-हेतुक (Cause of action) गठित होता है और वह समय जब वह उत्पन्न हुआ था;

(च) वे तथ्य जिनसे यह दर्शित हो कि न्यायालय को अधिकारिता है;

(छ) वह अनुतोष जिसका वादी दावा करता है;

(ज) जहां वादी ने मुजराई (Set-off) की अनुमति दी है या अपने दावे के किसी भाग का त्याग किया है, वहां इस प्रकार अनुज्ञात या त्यागी गई राशि; तथा

(झ) अधिकारिता और न्यायालय-फीस (Court-fees) के प्रयोजनों के लिए वाद की विषय-वस्तु के मूल्य का विवरण, जहां तक मामला अनुज्ञा दे।
