Failure to amend after Order

Full Text

If a party who has obtained an order for leave to amend does not amend accordingly within the time limited for that purpose by the order, or if no time is thereby limited then within fourteen days from the date of the order, he shall not be permitted to amend after the expiration of such limited time as aforesaid or of such fourteen days, as the case may be, unless the time is extended by the Court.

Plain English Summary

Mandates that an allowed amendment must be incorporated into the pleadings within the court-stipulated time or within 14 days by default, barring delayed incorporation unless judicial extension of time is granted.

Key Legal Elements

  • Strict 14-Day Statutory Default: If the court order specifies no timeframe, the party MUST incorporate the amendment within 14 days.
  • Loss of Right to Amend: Expiry of 14 days extinguishes the permission to carry out the amendment.
  • Court's Power to Extend: Court retains discretion under Section 148 CPC to extend the period upon showing sufficient cause.

Practical Note

Courtroom Procedure & Trap for Litigants: 1. The 14-Day Trap: Many advocates obtain leave to amend under Rule 17 but forget to file the physically amended plaint/WS within 14 days. On day 15, the right is barred! 2. Application for Extension of Time: If 14 days have lapsed, file immediately: 'Application under Section 148 read with Order VI Rule 18 and Section 151 CPC for Extension of Time to file Amended Pleading and placing Amended Plaint on Record'.
