Pleading to be signed

Full Text

Every pleading shall be signed by the party and his pleader (if any):

Provided that where a party pleading is, by reason of absence or for other good cause, unable to sign the pleading, it may be signed by any person duly authorized by him to sign the same or to sue or defend on his behalf.

Ram Kalewar Prasad Singh (2006) 1 SCC 75, the Supreme Court held that procedural defects such as an inadvertent lack of signature on a pleading or vakalatnama are curable irregularities. The court must grant opportunity to rectify rather than reject the plaint. 2. Companies & Juridical Persons: Must be signed by a Director or Principal Officer authorized by a specific Board Resolution (read with Order XXIX Rule 1).

प्रत्येक अभिवचन पर पक्षकार द्वारा और उसके प्लीडर द्वारा (यदि कोई हो) हस्ताक्षर किए जाएंगे:

परन्तु जहां अभिवचन करने वाला पक्षकार अनुपस्थिति के कारण या अन्य अच्छे हेतुक से अभिवचन पर हस्ताक्षर करने में असमर्थ है, वहां उस पर ऐसे किसी व्यक्ति द्वारा हस्ताक्षर किए जा सकेंगे जो उस पर हस्ताक्षर करने के लिए अथवा उसकी ओर से वाद लाने या प्रतिरक्षा करने के लिए उसके द्वारा सम्यक् रूप से प्राधिकृत है।
