On issue of summons for final disposal, defendant to be directed to produce his witnesses

Full Text

Where the summons is for the final disposal of the suit, it shall also direct the defendant to produce, on the day fixed for his appearance, all witnesses upon whose evidence he intends to rely in support of his case.

Plain English Summary

Directs that when summons is issued for final disposal of the suit, the defendant must be ordered to bring all oral and documentary witnesses to court on the first return date.

Key Legal Elements

  • Readiness for Summary Adjudication: Applicable to Small Cause suits and summary proceedings.
  • Dual Obligation: Defendant must produce both documents and oral witnesses on the very first appearance date.
  • Prevents Adjournment Abuse: Ensures expeditious final hearing without multiple intervening procedural dates.

Practical Note

Small Cause & Summary Practice: 1. Immediate Witness Preparation: In Small Cause courts or summary suits, counsel cannot expect routine adjournments for witness examination. Keep affidavits of evidence of witnesses ready on the returnable date. 2. Summons to Witnesses: If witnesses refuse to attend voluntarily, apply immediately for witness summons under Order XVI on the very first date.
