Summons to order defendant to produce documents relied on by him

Full Text

The summons to appear and answer shall order the defendant to produce all documents or copies thereof specified in rule 1A of Order VIII in his possession or power upon which he intends to rely in support of his case.

Plain English Summary

Requires the summons to explicitly direct the defendant to produce all foundational documents in their possession or power along with their written statement as mandated under Order VIII Rule 1A.

Key Legal Elements

  • Mandatory Document Production Warning: Puts defendant on notice to assemble documentary defense at the threshold.
  • Harmonized with Order VIII Rule 1A: Non-production at the time of written statement requires court leave later.
  • Avoids Trial Ambush: Ensures documentary evidence is disclosed prior to framing of issues.

Practical Note

Trial Preparation Tactics: 1. Counsel's Checklist upon Receipt of Summons: The defendant must compile all documents and receipts immediately. Under Order VIII Rule 1A(3), any document not filed with the Written Statement cannot be received in evidence later without special leave of the court. 2. Lost/Third-Party Documents: If documents are in the possession of an adversary or third party, state this explicitly in the written statement document list.
