Full Text
No party shall be ordered to appear in person unless he resides—
(a) within the local limits of the Court's ordinary original jurisdiction, or
(b) without such limits but at a place less than fifty or (where there is railway or steamer communication or other established public conveyance for five-sixths of the distance between the place where he resides and the place where the Court is situate) less than two hundred miles distance from the court-house.
Plain English Summary
Imposes strict territorial and distance limitations protecting distant litigants from being compelled to appear in person in court.
Key Legal Elements
- Territorial Criterion: Party residing within court's ordinary original jurisdiction can be summoned in person.
- Distance Thresholds: Outside jurisdiction, cannot be compelled if residing beyond 50 miles (or 200 miles with established public transport/rail connectivity).
- Protection for Distant Litigants: Court must examine distance before issuing coercive personal appearance warrants.
Practical Note
Courtroom Practice: 1. Quashing Personal Appearance Orders: If a civil court directs an outstation litigant living 500 km away to appear in person, file an 'Application under Order V Rule 4 read with Section 151 CPC for recalling order of personal appearance'. 2. Alternative of Video Conferencing: In modern practice, courts substitute physical appearance with VC (Virtual Court) attendance under High Court Video Conferencing Rules.
