Plain English Summary

Authorizes the trial court to order the personal appearance of either the defendant or plaintiff where individual attendance is necessary for examining parties or settling terms.

Key Legal Elements

  • Judicial Power for Personal Attendance: Overrides general liberty to appear through pleader/agent.
  • Applicable to Both Parties: Can direct defendant in summons or plaintiff by subsequent order.
  • Subject to Rule 4: Limited by statutory residential/distance thresholds and gender exemptions (Section 132/133).

Practical Note

Application & Enforcement: 1. Invocation in ADR & Family Matters: Frequently used by civil judges at the first hearing (Order X) to explore mediation, conciliation, or direct questioning on disputed signatures. 2. Consequence of Non-Appearance: If a party ordered to appear in person under Rule 3 fails to do so without lawful excuse, the court can proceed under Order IX Rule 12 and pass adverse ex parte or dismissal orders.
