Points to be defined and recorded
Full Text
Where additional evidence is directed or allowed to be taken, the Appellate Court shall specify the points to which the evidence is to be confined, and record on its proceedings the points so specified.
Plain English Summary
Requires the appellate court to define and record in its proceedings the precise points to which the additional evidence must be confined, preventing roving inquiries.
Key Legal Elements
- Mandatory Scoping: Additional evidence cannot degenerate into an open-ended retrial.
- Specific Points in Order Sheet: Appellate court must clearly articulate the exact factual points to which examination is confined.
- Binding on Delegate Court: If evidence is taken by a subordinate court under Rule 28, it cannot permit questions beyond the points defined under Rule 29.
Practical Note
Limiting Evidence to Defined Points: 1. Safeguard Against Roving Inquiries: Rule 29 is a statutory check against fishing expeditions. The order allowing Rule 27 application must expressly frame the precise question (e.g. 'confined strictly to proving the genuineness of registered gift deed dated 12.03.1995'). 2. Objection to Irrelevant Questions: If the opposite party attempts to lead evidence beyond the points specified under Rule 29, an immediate objection must be raised based on the terms of the referral order.
