Mode of taking additional evidence

Full Text

Wherever additional evidence is allowed to be produced, the Appellate Court may either take such evidence, or direct the Court from whose decree the appeal is preferred, or any other subordinate Court, to take such evidence and to send it when taken to the Appellate Court.

Plain English Summary

Specifies that where additional evidence is admitted under Rule 27, the appellate court may record it itself or direct the trial court or any subordinate court to record it and transmit it back.

Key Legal Elements

  • Discretion of Appellate Court: Can record additional evidence itself directly in court.
  • Delegation to Subordinate Court: Can direct the trial court or another subordinate court to examine the witness or receive documents.
  • Transmission Back: Subordinate court merely records evidence and sends depositions/exhibits to the appellate court; it renders no finding.
  • Right of Cross-Examination: Opposite party must be afforded full right to cross-examine any witness examined under this rule.

Practical Note

Procedural Steps for Recording Additional Evidence: 1. Practical Practice: In High Courts and District Courts, when documentary evidence of unimpeachable character (e.g. certified public records, registered sale deeds, government notifications) is admitted under Rule 27, the appellate court usually takes it on record directly by exhibiting it under Rule 28. If oral evidence and lengthy cross-examination are required, the court typically remits the matter to the trial court to record the testimony and transmit the deposition back. 2. Cross-Examination is Mandatory: Admission of additional oral evidence without affording the adverse party an opportunity to cross-examine is a violation of natural justice.
