Findings and evidence to be put on record. Objections to findings

Full Text

(1) Such evidence and findings shall form part of the record in the suit; and either party may, within a time to be fixed by the Appellate Court, present a memorandum of objections to any finding.

(2) Determination of appeal.—After the expiration of the period so fixed for presenting such memorandum the Appellate Court shall proceed to determine the appeal.

Appellate Independence: The appellate court is not bound by the findings of the trial court on the remitted issues; it must independently assess the evidence recorded during the remand along with the objections.

(1) ऐसा साक्ष्य और निष्कर्ष वाद के अभिलेख का भाग होंगे; और कोई भी पक्षकार, अपीलीय न्यायालय द्वारा नियत किए जाने वाले समय के भीतर, किसी निष्कर्ष के प्रति आक्षेपों का ज्ञापन प्रस्तुत कर सकेगा।

(2) अपील का अवधारण—ऐसा ज्ञापन प्रस्तुत करने के लिए इस प्रकार नियत कालावधि के अवसान के पश्चात अपीलीय न्यायालय अपील का अवधारण करने के लिए अग्रसर होगा।
