Service of process on recognised agent
Full Text
(1) Processes served on the recognised agent of a party shall be as effectual as if the same had been served on the party in person, unless the Court otherwise directs.
(2) The provisions for the service of process on a party to a suit shall apply to the service of process on his recognised agent.
Plain English Summary
Equates service of court summons and processes upon a recognized agent to personal service on the litigant, applying all standard procedural rules of service.
Key Legal Elements
- Deemed Personal Service: Summons served on agent binds the principal unless court orders personal service.
- Application of Order V Rules: All statutory modes under Order V (summons) apply equally to service on recognized agents.
- Judicial Discretion: Court retains power to direct service on the litigant directly despite agency.
Practical Note
Courtroom Practice: 1. Execution & Summons Defense: When serving corporations, non-resident NRIs, or busy business owners, serving the duly constituted power-of-attorney holder constitutes 100% valid service under Rule 3. 2. Scope of Authority: Ensure the POA filed on record explicitly contains the power to accept summons and court notices; otherwise, the principal may seek to set aside an ex parte decree under Order IX Rule 13 claiming improper service.
