Removal of attachment when security furnished or suit dismissed
Full Text
Where an order is made for attachment before judgment, the Court shall order the attachment to be withdrawn when the defendant furnishes the security required, together with security for the cost of the attachment, or when the suit is dismissed.
Plain English Summary
Mandates the withdrawal and lifting of an attachment before judgment upon the defendant furnishing the required security (plus costs of attachment) or automatically upon the dismissal of the plaintiff's suit.
Key Legal Elements
- Mandatory Language: Court 'shall' order the withdrawal; no discretion to maintain attachment once conditions are met.
- Two Triggering Events: (1) Furnishing required security plus attachment costs, or (2) Dismissal of the suit.
- Automatic Termination on Dismissal: The dismissal of the suit puts an immediate end to the attachment before judgment.
- Cost Security Requirement: Defendant must also secure the actual expenses incurred in executing the attachment.
Practical Note
Automatic Dissolution Upon Suit Dismissal: 1. End of Attachment on Dismissal: The moment the plaintiff's suit is dismissed (whether on merits, for default, or rejection of plaint under Order VII Rule 11), the attachment before judgment automatically falls to the ground. The court has a statutory duty under Rule 9 to pass a formal order of withdrawal. 2. Release of Encumbrance: Counsel for the defendant should immediately obtain a certified copy of the withdrawal order and submit it to the Sub-Registrar / Revenue Authority to clear the encumbrance certificate.
