Adjudication of claim to property attached before judgment

Full Text

Where any claim is preferred to property attached before judgment, such claim shall be adjudicated upon in the manner hereinbefore provided for the adjudication of claim to property attached in execution of a decree for the payment of money.

Plain English Summary

Directs that third-party claims or objections to property attached before judgment shall be fully adjudicated under the comprehensive claim-adjudication procedure of Order XXI Rule 58.

Key Legal Elements

  • Third-Party Objections: Strangers claiming ownership, possession, or mortgage interest in the attached property can file objections.
  • Governed by Order XXI Rule 58: Court must investigate title and possession; cannot relegate objector to a separate suit.
  • Decree Status: Under Order XXI Rule 58(4), the adjudication of the claim has the full force of a decree and is appealable as a decree.
  • Substitution by 1976 Amendment: Aligned Rule 8 with the modernized Order XXI Rule 58 regime.

Practical Note

Full Adjudication as a Regular Suit: 1. Scope of Inquiry: Post the 1976 CPC Amendment, an objection under Order XXXVIII Rule 8 read with Order XXI Rule 58 is not a summary inquiry. All questions of right, title, or interest arising between the claimant and the plaintiff must be conclusively determined by the court in the same proceeding. 2. No Separate Suit Permitted: The objector cannot file an independent suit; the decision operates with the finality of a decree subject to regular first appeal under Section 96 CPC.
