Agricultural produce not attachable before judgment

Full Text

Nothing in this Order shall be deemed to authorise the plaintiff to apply for the attachment of any agricultural produce in the possession of an agriculturist, or to empower the Court to order the attachment or production of such produce.

Plain English Summary

Provides absolute statutory immunity against attachment before judgment for any agricultural produce in the possession of an agriculturist to safeguard agrarian livelihoods.

Key Legal Elements

  • Absolute Prohibition: Neither plaintiff can apply nor court can order attachment of agricultural produce before judgment.
  • Applies to Agriculturists: Produce must be in the lawful possession of an agriculturist.
  • Covers Standing Crops & Harvested Grain: Encompasses crops on the field and grain stored in granaries/threshing floors.
  • Harmonious with Section 60 CPC: Extends statutory agrarian protections to the pre-trial interlocutory stage.

Practical Note

Agrarian Protection at Interlocutory Stage: 1. Total Immunity for Farm Produce: While agricultural produce may be liable to restricted attachment in post-decree execution under Section 60/Order XXI Rule 44, Order XXXVIII Rule 12 imposes a total and unconditional bar on pre-judgment attachment of farm produce in the hands of an agriculturist. 2. Bar on Interlocutory Coercion: Creditors cannot coerce farming defendants by seizing standing crops or harvested harvest prior to establishing liability at trial.
