Provisions applicable to attachment

(1) The provisions of this Code applicable to an attachment made in execution of a decree shall, so far as may be, apply to an attachment made before judgment which continues after the judgment by virtue of the provisions of rule 11.

(2) An attachment made before judgment in a suit which is dismissed for default shall not become revived merely by reason of the fact that the order for the dismissal of the suit for default has been set aside and the suit has been restored.

No Automatic Revival of Attachment on Restoration: 1. 1976 Amendment Rationale — Sub-rule (2): Prior to 1976, there was a divergence of opinion among High Courts as to whether restoration of a suit revived an attachment before judgment. Sub-rule (2) conclusively codified the law: an attachment before judgment dies permanently upon dismissal of the suit for default. Even if the suit is restored under Order IX Rule 9, the attachment does NOT revive. 2. Duty of Plaintiff's Counsel: Upon getting the suit restored, plaintiff's counsel must immediately file a fresh application under Order XXXVIII Rule 5 for a fresh attachment before judgment, otherwise the defendant can lawfully alienate the property.

(1) इस संहिता के वे उपबंध जो किसी डिक्री के निष्पादन में की गई कुर्की पर लागू होते हैं, जहां तक हो सके, निर्णय के पूर्व की गई ऐसी कुर्की पर लागू होंगे जो नियम 11 के उपबंधों के आधार पर निर्णय के पश्चात भी जारी रहती है।

(2) ऐसे वाद में जो व्यतिक्रम (Default) के कारण खारिज कर दिया जाता है, निर्णय के पूर्व की गई कोई कुर्की केवल इस तथ्य के कारण पुनर्जीवित (Revived) नहीं होगी कि व्यतिक्रम के कारण वाद की खारिजी के आदेश को अपास्त कर दिया गया है और वाद को पुनः संस्थित (Restore) कर दिया गया है।
