Notice of day for receiving evidence of applicant’s indigency

Full Text

Where the Court sees no reason to reject the application on any of the grounds stated in rule 5, it shall fix a day (of which at least ten days' clear notice shall be given to the opposite party and the Government pleader) for receiving such evidence as the applicant may adduce in proof of his indigency, and for hearing any evidence which may be adduced in disproof thereof.

Plain English Summary

Requires the court, if the application survives Rule 5 screening, to schedule an evidentiary hearing on indigency with at least ten days' clear notice to both the opposite party and the Government Pleader.

Key Legal Elements

  • 10 Days Clear Notice: Mandatory statutory notice period.
  • Dual Notice Recipients: (a) The contesting defendant, and (b) The Government Pleader (protecting State revenue).
  • Bilateral Evidentiary Scope: Applicant adduces proof of indigency; opponent and GP adduce disproof.

Practical Note

Role of the Government Pleader: Notice to the Government Pleader is mandatory because court fees represent state sovereign revenue. Government Pleaders frequently summon revenue patwaris or municipal tax collectors to check whether the applicant owns undisclosed land or vehicles.
