Full Text
The Court shall reject an application for permission to sue as an indigent person—
(a) where it is not framed and presented in the manner prescribed by rules 2 and 3, or
(b) where the applicant is not an indigent person, or
(c) where he has, within two months next before the presentation of the application, disposed of any property fraudulently or in order to be able to apply for permission to sue as an indigent person: Provided that no application shall be rejected if, even after the value of the property disposed of by the applicant is taken into account, the applicant would be entitled to sue as an indigent person, or
(d) where his allegations do not show a cause of action, or
(e) where he has entered into any agreement with reference to the subject-matter of the proposed suit under which any other person has obtained an interest in such subject-matter, or
(f) where the allegations made by the applicant in the application show that the suit would be barred by any law for the time being in force, or
(g) where any other person has entered into an agreement with him to finance the litigation.

न्यायालय निर्धन व्यक्ति के रूप में वाद लाने की अनुज्ञा के आवेदन को नामंजूर (Shall reject) कर देगा—
(क) जहां वह नियम 2 और 3 द्वारा विहित रीति से विरचित और प्रस्तुत नहीं किया गया है, अथवा
(ख) जहां आवेदक निर्धन व्यक्ति नहीं है, अथवा
(ग) जहां उसने आवेदन प्रस्तुत करने से ठीक पूर्ववर्ती दो मास (Two months) के भीतर कपटपूर्वक अथवा निर्धन व्यक्ति के रूप में वाद लाने की अनुज्ञा के लिए आवेदन करने में समर्थ होने के उद्देश्य से किसी संपत्ति का व्ययन (अंतरण) कर दिया है: परंतु कोई भी आवेदन नामंजूर नहीं किया जाएगा यदि आवेदक द्वारा व्ययनित संपत्ति के मूल्य को ध्यान में रखने के बाद भी आवेदक निर्धन व्यक्ति के रूप में वाद लाने का हकदार होता; अथवा
(घ) जहां उसके अभिकथनों से कोई वादहेतुक (Cause of action) दर्शित नहीं होता, अथवा
(ङ) जहां उसने प्रस्तावित वाद की विषय-वस्तु के संदर्भ में कोई ऐसा करार किया है जिसके अधीन किसी अन्य व्यक्ति ने ऐसी विषय-वस्तु में कोई हित अभिप्राप्त कर लिया है, अथवा
(च) जहां आवेदन में आवेदक द्वारा किए गए अभिकथनों से यह दर्शित होता है कि वाद तत्समय प्रवृत्त किसी विधि द्वारा वर्जित (Barred by law) होगा, अथवा
(छ) जहां किसी अन्य व्यक्ति ने उस मुकदमे का वित्तपोषण (Finance the litigation) करने के लिए उसके साथ कोई करार किया है।
