Recovery of amount of court-fees
Full Text
Where an order is made under rule 10, rule 11 or rule 11A, the court shall forthwith cause a copy of the decree or order to be forwarded to the Collector who may, without prejudice to any other mode of recovery, recover the amount of court-fees specified therein from the person or property liable for the payment as if it were an arrear of land revenue.
Plain English Summary
Empowers summary revenue recovery of deferred court fees by directing the court to forward the decree to the District Collector for realization as arrears of land revenue.
Key Legal Elements
- Automatic Transmission to Collector: Court transmits copy of decree/order forthwith.
- Coercive Recovery Power: Recovery as arrears of land revenue under State Revenue Recovery Acts.
- Target Assets: Recoverable from the person liable or from the charged suit property.
Practical Note
Handling Tehsildar Recovery Citations: Upon receiving a recovery citation from the Tehsildar under Rule 14, verify whether the decree held the plaintiff or defendant liable. If the citation was mistakenly addressed to the indigent plaintiff despite a decree against the defendant, immediately apply to the Collector and the trial court for stay of coercive recovery.
