Plain English Summary

Deems all court-fee disputes between the State Government and suit parties to be questions arising in execution under Section 47, eliminating separate suits and enabling direct resolution in execution.

Key Legal Elements

  • Section 47 Integration: Bar on separate suits; disputes resolved directly by executing court.
  • Deemed Party Status: State Government enjoys party status solely for recovering court fees.
  • Appealability: Orders deciding court fee disputes under this rule are appealable as decrees under Section 47.

Practical Note

Challenging Illegal Revenue Demands Under Section 47: If the Collector issues an erroneous citation for recovery of an excessive court fee against the successful plaintiff instead of the defendant, file an objection before the executing court under Section 47 read with Order XXXIII Rule 13. A separate suit is barred.
