Costs where indigent person succeeds

Full Text

Where the plaintiff succeeds in the suit, the Court shall calculate the amount of court-fees which would have been paid by the plaintiff if he had not been permitted to sue as an indigent person; such amount shall be recoverable by the State Government from any party ordered by the decree to pay the same and shall be a first charge on the subject-matter of the suit.

Plain English Summary

Mandates that where an indigent plaintiff succeeds, the court must calculate the deferred court fees and direct recovery from the judgment-debtor or losing party, declaring the unpaid court fee to be a statutory first charge on the subject-matter of the suit.

Key Legal Elements

  • Calculation of Deferred Fee: Computing ad valorem court fee waived at filing.
  • Recovery from Defeated Party: State recovers fee directly from the judgment-debtor.
  • First Charge on Suit Property: Government claim takes precedence over all other private charges, mortgages, or transfers.
  • Execution Priority: Execution under Rule 14 executed by the Collector as arrears of land revenue.

Practical Note

Executing Decrees Subject to State First Charge: When drafting the final decree in favor of an indigent plaintiff, ensure the decree specifies that the court fees shall be recovered from the defendant. In execution, the executing court will first satisfy the State Government's court fee claim before releasing the balance proceeds to the plaintiff.
