Appearance of partners

Full Text

Where persons are sued as partners in the name of their firm, they shall appear individually in their own names, but all subsequent proceedings shall, nevertheless, continue in the name of the firm.

Plain English Summary

Mandates that when a firm is sued, partners must enter appearance individually in their personal names, while all pleadings, proceedings, and final orders continue in the collective firm name.

Key Legal Elements

  • Individual Appearance: Partners file memo of appearance / Vakalatnama mentioning their individual names.
  • Continuation in Firm Name: Title of suit remains 'M/s XYZ Firm'.
  • Multiple Partners: Different partners can engage separate advocates if their defenses conflict.

Practical Note

Vakalatnama Drafting for Defendant Firm: When drafting a Vakalatnama for a defendant firm, title it: 'A.B., partner of M/s XYZ & Co., on behalf of himself and the defendant firm'. Never file a Vakalatnama simply signed 'For M/s XYZ & Co.' without disclosing the individual partner's name, as the registry will raise an objection under Rule 6.
