Plain English Summary
Requires that when summons is served on a person at the firm's premises, written notice must be served concurrently stating whether they are served as a partner or manager, creating a statutory presumption of service as partner in the absence of such notice.
Key Legal Elements
- Concurrent Written Notice: Must specify capacity (Partner, Manager, or both).
- Statutory Default Fiction: If capacity notice is omitted, law presumes service as a partner.
- Significance for Personal Liability: A person served as partner faces personal execution under Order XXI Rule 50.
Practical Note
Manager Protection Protocol: If an employee/manager receives summons without the capacity notice, they are deemed served as a partner under the default rule. Counsel advising the manager must promptly enter an appearance under protest under Rule 8 denying partnership to prevent personal execution under Order XXI Rule 50.
